What do you think? Should Mischa have been more careful about where she was tanning if she didn't want to have it documented? Or is the paparazzi industry completely out of control?

But the photographer claims that she was somewhere public and should have been more mindful.
"We spoke to each other on the island, and that's when I showed her my camera and I hadn't taken any shots of her topless. I did warn her it was a public place, and if she wanted privacy she shouldn't be there. I'm not a perv, and I didn't intentionally mean to embarrass her. I don't just set out and start my day thinking I want to get any celebrity topless."
What do you think? Should Mischa have been more careful about where she was tanning if she didn't want to have it documented? Or is the paparazzi industry completely out of control?

I at first wanted to say she should be more careful since she's in the public eye, what'd she expect. But then I thought I would be totally creeped out if some guy was taking pics of me sunbathing, never mind sun bathing topless.
I think there should be laws to protect celebrities from intrusion in their private time but until there are, celebs need to be more careful. It's a sad and unfair truth. As for the pictures, the girl doesn't have cellulite. It looks like she was lying on a rough terry-cloth towel that made impressions in her skin. You can see the marks on her back, as well. Since when does one get cellulite on their backs and shoulders?
At LEAST SOMEONE CARES ENOUGH TO PHOTOGRAPH YOUR UNTALENTED, FUGLY ASS, MISCHA.

I think she should have been more watchful of what she is wearing. She wasn't in a private place (according to the article) and should expect to have photogs watching her. Saying that, if my thighs looked like that, I would be more upset about that then them showing me with my naked breast covered with a shirt.
It sucks if you can't go anywhere anymore just because you have to be afraid that your picture ends up in the paper.
It's been pretty well documented in the blogs and tabloids that she does in fact have cellulite, so no...is is not from sitting on a terry towel.
As for the pictures- if you do not want to be photographed topless, then wear a top.
Fame isn't something you turn on and off at a whim. If you're in a public place and choose to sunbathe topless, do so at your own risk.
I think she should be placing the blame on her own shoulders.
I don't like it, but I don't think the photographer did anything wrong here. Now, if he took the shots with a telephoto lens through the window, then that's wrong and creepy. When she's on her balcony for all the world to see, then he's within his rights.
I've gotta agree. She was in public, or at least in a place where other people can see her. Too bad for poor little Mischa got caught without her top on.....wear it if you don't want people to see!
It's not like someone rented a helicopter or was repelling from the building to get the shot.
She's a celebrity and it's part of the whole celeb lifestyle (not that she's done anything lately except get a DUI and get caught with a lil mary jane.....oh and wear some heinous outfits......), but yea....
shes lucky anyone wanted a shot of her.. but if your a celeb you shouldnt be half naked on the balcony if you dont want anyone to see.
Well if she was in a public place sunbathing topless what does she expect? Is she really that stupid? He did nothing wrong. Now if she was at home in her back yard and he was up in the neighbor's tree then that is going way too far. Her backside is not very attractive for someone so young. She is not even over weight so I don't get why she looks that bad. I agree, I would more upset about the cellulite than a bare boob you can hardly see.
If it were up to me and I made all of the laws in this country (heehee) I would absolutely restrict ALL public photos of celebs UNLESS:
1. They are on set
2. They are at a celebrity function
3. They are at a premiere
4. They are at a photo shoot
etc., etc.
Basically anything that has to do with their "work" would be fine. I feel there is absolutely NO right for paps to be up in their face while they are trying to shop, or sun bathe in their own backyard. I can't believe law makers haven't put a stop to this yet?!?!? Just proves how much money is in tabloids. So sad.
I think if somebody wants to be topless in a relatively public location they shouldn't get upset if a photographer happens to be there.
If the photographer was using extreme measures -- super telefoto lens or a helicopter or something - it would be different.
I WANT to have sympathy for her, but I don't. (And it's got nothing to do with Mischa herself.)
it looked like she was on a patio..was she not? i wouldn't want to be photographed if i was there on the patio, but i would expect it if i was in the middle of the beach or something..

Deb, I agree completely with your list. The only hard part is that the "famewhores" (people who CALL the paps and tip them off because they WANT to be in the mags) would be disappointed because they WANT to be photographed shopping, vacationing, etc. It's so gross.
I get creeped out by the stalker shots (celebs at home or at a private event). But sometimes even those are a set up. It's so hard to tell what is reality anymore in Hollyweird.
I don't think ANYONE, celebrity or private person should be photographed (we know plenty of non-celebrities get snapped by pervs as well).
Also all paparazzi make it seem as if celebrities aren't allowed to breathe the same air anymore and see the sun like everybody else. That's ridiculous.

we are keeping getting pics over oics from the ol'same "celebs", but we all know that there are a tonne more famous people ot there of whom we never get a vacation photo to see....
i think it's because most of those celebs want to be seen. even european/asian fans who has never been to the u.s. know the "ivy" (or those other 5 places, celebs keep showing up) just because all the pics are from places like those.
btw: about mischa's complaining: it's kind of became a trend/must-do for celebs NOT to like being taken a pic of, isn't it?
Let's see: I'm rich and can go anywhere in the world I want and I can buy just about anything I need.
So why on earth don't these rich and famous airheads go somewhere private or buy a place with a modicum of privacy, and then they can do anything they want.
Why not? Because they're exhibitionists and they thrive on people seeing them, clamoring for them. I doubt she'd have been so upset if the pictures represented her as smokin' hot. Mischa is a drunk and a doper; wadda ya expect?
She's only making a big deal out of it because she sucks and wants to keep her name in the press. I met her when she was still on the OC (which they filmed in San Pedro, CA and Palos Verdes, CA) and she was such a bee-yoch! Adam whats-his-face (who played Seth) told us she had bad cellulite back then!
The attention comes with the job. Accept it. Unless it's an Uma stalker case, get over it. Like Annie said, there are plenty of celebs who have a private life.
I agree with #12. There should definitely be laws for the papparazzi. These stars are human beings...not animals at the zoo. (Well, maybe most.)
She needs to get over it. She's an attention monger! She was in a public enough place. If she didn't want those photos taken, why would she have gone topless like that? She lives in LA and knows the paps are everywhere!
omg. im more shocked with the amount of cellulite she has than the invasion of privacy. how does she have to much? shes not obese, i doubt shes even overweight.

I'm so sorry to say this but this is some serious cellulite!! I'm shocked, I didn't even know it could get that bad!! Are those pics for real, no photoshop included? I'm still shocked that cellulite can look like this.. sure, lightning is bad too in these pics. I feel sorry for the girl and I'm usually not much a fan of hers.

No one is mentioning the fact that the pap actually WARNED HER that she was in a public place and that he could legally take pics of her so she should not go topless if she didn't want that to happen. She did it anyway! What does that tell you? She WANTS the attention!!!!
The cellulite just proves that skinny does not equal healthy! I'm probably 30lbs heavier than Mischa but I don't have any cellulite. That's because I work out and try to stay healthy. Where a lot of celebs starve themsleves or use drugs to stay thin. They do it the wrong way, and really why should they care, it all gets airbrushed out anyway! LOL!
i agree with #24 i also think that is so much, i would think it would have to be fake, but don't know
