Things are only getting worse for actress Kelly Rutherford as she battles her estranged husband Daniel Giersch in a custody battle for their two year old son Hermes and three month old daughter Helena. Kelly obtained a restraining order against Giersch on Thursday according to the Los Angeles Superior Courts Records.

Giersch’s lawyer has called the claims “fabricated accusations”. However the order will stay in effect for 21 days until they meet again in court on October 15.

This is sad because of the kids, but she has publicly talked about him being an abusive person. If this is the case than i’m glad she’s taking action and is protecting herself and her kids. This guy is a looser!!!!
