Kelly Rutherford finally got a good ruling in her ongoing custody battle with her ex, Daniel Giersch, over their two children. A judge in Monaco ruled that her kids, Hermes and Helena, were to spend the summer with her in the United States. Kelly, as you can imagine, is ecstatic to have her kids back in the States even if it’s only for a short period of time.
I am over the moon that my children are back in the United States. I haven’t stopped hugging and kissing them.”
That’s completely understandable! However, the custody battle is not over: the kids are to return to Monaco at the end of the summer.
In 2012 a judge in the US ruled that the kids should live with their father in Monaco since Daniel was forbidden from entering the US after having his Visa revoked. His Visa was revoked after Kelly- or her attorney, it’s unclear exactly who- alleged that he was involved in some kind of illegal activities. Since Daniel’s not a US citizen, the allegation alone was enough to get his Visa revoked. Kelly, however, said the judge only ruled that the kids were supposed to visit their father in Monaco, not live there.
Whether he worked those matters out or not, the children were supposed to come home after only a visit with their father abroad. Obviously, three years is not a visit — especially in a young child’s life when, as every parent knows, each moment is priceless because children grow and change so quickly.”
Of course Kelly is hoping that her kids will stay in the United States.
Now that Congress is involved and people in Washington are talking about how this case is an example of a much bigger problem, I’m hopeful my children will be able to stay here, and go to school here and live here just like other American children.
“I’m blessed to be an American, and I hope this is finally the end to a very long and difficult time period when my children were not allowed to live in their own country.
“My children were toddlers — only 2 and 5 years old when they left this country. They are now 6 and 9. Those years are gone, but I am looking forward to watching them grow and thrive here in the United States — with family and friends who love them very much, and have missed them terribly over these past few years.”
Oh my. Something tells me Kelly isn’t planning on sending her children back to Monaco at the end of the summer. I wonder what it’s like for Hermes and Helena being here now, since they’ve spent the last few years in Monaco. It’s probably quite a culture switch. Whatever the courts ultimately end up working out, I hope the decision keeps the children’s best interest in mind.
