Unfortunately, the donut shop was the big loser in this case. The whole fiasco triggered an investigation by the health department which downgraded them to a B because food is not supposed to be left out in front of the public. In other words, when the donut server kept leaving the donuts exposed on the top of the case to get more donuts, which was how Ariana and her friend were able to spit on them, it was actually a violation.
The donut shop owner told People:
We got a B because the donuts were on top of the tray, and we were actually stocking up. My employees kept going in the back and grabbing some more … They were minor things: little, tiny, minor things that were fixed in three days.”
The health department will come back for another investigation on July 15: hopefully they will get their “A” back. Ariana and her friend really were in the wrong, here: perhaps her people quietly negotiated a settlement with the donut shop owner so no charges were filed? I wouldn’t be surprised: usually those types of settlements also include a non-disclosure agreement, so if that did happen, we wouldn’t know about it. It’s good that the whole thing is over.
