Well, Kelly Rutherford clearly got the notice to appear in court today, and she did show up. However, she reportedly showed up solo: defying the court summons to appear in court WITH her kids. Although Daniel Giersch is not in court, his mother is said to be there, probably with the idea that she would be the ones to take the kids to Monaco. UPDATE: The judge’s ruling is after the break as the final update.
I hope Kelly realizes the position she’s putting herself in. If the judge finds her in contempt of court for not bringing the kids, that could mean JAIL. I know she wants to be with her children, but she can’t be with them if she’s behind bars.
TMZ has the picture of Kelly arriving at the courthouse solo. I have to wonder if she’s truly acting under legal advice or basically defying her attorneys at this point? Lawyers, including one of her former attorneys, seemed pretty clear that her refusal to return her kids to Monaco was more detrimental to her attempts to get custody than helpful.
UPDATE: People reports that New York Superior Court Judge Gesmer “angrily” asked Kelly where her children were when she arrived in court alone. Her lawyer said that Hermes and Helena were “close by, maybe 10 minutes away” to protect them from the media circus. Judge Gesmer said she did not “look kindly upon” Kelly not bringing the children to court as required. Kelly reportedly attempted to address the judge directly, but the judge didn’t allow it.
Daniel Giersch’s legal team reportedly asked that the media be excused from the courtroom, and the judge complied with the request. Things are NOT off to a good start for Kelly.
2nd UPDATE: The kids reportedly were brought into the court via a side entrance a little after 12 noon.
3rd UPDATE: The New York judge upheld the Monaco court order and ordered the children returned to Monaco. Daniel’s mother reportedly took the children from the courthouse, and they are on their way to the airport. Poor Kelly; she must be devastated.
