Kelly Rutherford visited ‘Good Morning America’ today to talk about the latest turn in her protracted custody battle with her ex-husband, Daniel Giersch. A New York judge ordered her to return their kids to Monaco earlier this week after she refused to send them back last week.
Kelly said she was doing okay, “processing” everything that had occurred.
I walked into a courtroom where everything felt like it was already done. It was a done deal. His mother was sitting there with plane tickets, smiling, ready to take them…
I was accused of things I was not able to even defend.”
She said it was almost a relief how the transfer was done, however, with Hermes and Helena not having to sit in court and watch everything happen.
I’m glad they didn’t have any notice, in a way I think it would’ve been harder. I was happy that it ended up happening because they didn’t have to sit in the courtroom and watch it all happen or deal with media or anything that would have been sort of harmful.”
Kelly seemed to be doing okay.
Her attorney, Wendy Murphy, basically argued that the Monaco court order should not have been valid since the kids are US citizens, Kelly is a US citizen, and even Daniel isn’t a citizen of Monaco. She argued:
He violated his agreement. He violated an American court order, and the saddest part of this story is no American court seems to give a d**n.”
The jurisdictional issues do seem absolutely crazy, but ultimately, if the Monaco court has jurisdiction, then it sounds like she needs to fight this in Monaco, which was kind to her, even if it’s a foreign court. Hopefully this will work out in a way that’s good for the kids. Watch Kelly’s interview on ‘GMA’:
