It turns out Kelly Rutherford wasn’t done fighting in the US courts after a New York judge ordered her to send her children, Hermes and Helena, back to Monaco. On August 11 she filed a federal lawsuit in an attempt to get her kids returned from Monaco.
Unfortunately, that legal maneuver didn’t work any better than the other ones she’s tried. The judge reportedly denied Kelly’s petition on the grounds that it was a state matter, not a federal one.
It sounds like Kelly needs to resign herself to fighting her custody battle in Monaco, although I see her point: it does seem incredibly unfair for the California court to order the kids to live in Monaco while maintaining their US citizenship and then, a few years later, declare that it no longer has jurisdiction over the case because the kids now live in Monaco.
Her attorney’s phone call to the State Department alleging Daniel Giersch was involved in illegal activity was a COLOSSAL mistake. I feel the worse for the kids; this can’t be easy for them.
