Here’s the latest on the Gabriel Aubry - Olivier Martinez - Halle Berry saga. TMZ reports law enforcement sources say Gabriel is unlikely to face charges after his arrest on Thanksgiving.
We’ve learned the case will be sent to the L.A. City Attorney’s Office Thursday, but cops will not make a recommendation as to whether Gabriel should be prosecuted.
Law enforcement sources connected to the case tell us … the consensus is that the fight was “mutual combat.” As such, we’re told it’s “highly unlikely” charges will be filed.
I guess this means Gabriel’s push for Olivier to face criminal charges for assault is unlikely to be successful, either. Police report Halle’s security cameras did not capture Olivier and Gabriel’s fight because they were aimed at the security fence: something a security company had advised when Halle was dealing with a stalker. However, sources (presumably close to Gabriel) claim some of the video footage of the stalker trespassing included the stalker in the driveway, which means cameras were pointed there (and where the fight occurred). The LA District Attorney reportedly has that video.
Meanwhile, it’s not clear what happened with Gabriel’s efforts to have the restraining order lifted so he could see Nahla. TMZ reports the restraining order was not lifted but is due to expire tomorrow. Radar Online reports the judge ruled Gabriel could see Nahla. Maybe visits can resume after tomorrow? The only clear thing right now is that the saga likely isn’t over…
