Surprise In Custody Case For Jackson Children

We already heard about Katherine Jackson and Debbie Rowe coming to a custody agreement, naming Katherine as the permanent guardian of Michael Jackson's three children: Prince, Paris, and Blanket. The judge signed off on their agreement this morning.

But here is a surprise (at least to me) Michael's dermatologist, Arnie Klein, had attorneys present in the courtroom!

The doctor wanted a say over the education and care of Jackson's two
eldest children
. ET reports that the court found that Klein had no
standing to make that request and his legal team left the courtroom."

So much for "I am not the father of these children," huh?

According to Entertainment Tonight, notes were presented in court this morning signed by Prince and Paris requesting that they stay with their grandmother. The judge reportedly allowed them 83.5% of the living allowance that was requested for them, as well as a living allowance for Katherine (who said she was financially dependent on Michael).

Katherine Jackson Will Retain Custody Of Grandchildren

According to Katherine Jackson's attorney, Katherine and Debbie Rowe have come to an agreement regarding custody of the Jackson children (Prince, 12, Paris, 11, and Blanket, 7). Katherine will retain custody.

Katherine's attorney Londell McMillan said on CBS' The Early Show
Thursday: "It's an agreement, an agreement for the best interests of
the children. This is not a money deal. This is not about money."

Asked if the issue of custody and Rowe had been resolved, McMillan said on The Early Show, "We will be making an announcement very shortly on that issue, and all of the parties are resolved. There is no situation better for these children than for them to be raised and reared in the loving care of Mrs. Katherine Jackson."

He dismissed reports that Joe Jackson shouldn't be involved in
raising the children. Said McMillan, "I don't think it's valid at all.
I think Joe Jackson is the husband of Mrs. Jackson, but he's not living
in Los Angeles."

Debbie reportedly will retain her parental rights and get visitation with her the two older children. She will begin to forge a relationship with them with the help of a psychologist. Debbie will not be receiving any additional money as part of this agreement.

Debbie Rowe Sues For Defamation

Remember earlier this week when a woman named Rebecca White claimed to have emails from Debbie Rowe about Debbie's thoughts on getting custody of her children?

Well, Debbie has responded: with a defamation lawsuit.

In the lawsuit, filed in in [sic] Los Angeles Superior Court, Rowe says the
woman, Rebecca White, committed defamation, invasion of privacy and
intentional infliction of emotional distress, Reuters reports.

White claimed to be a "close friend" of Rowe, but Rowe says she does
not know her. The suit claims White fabricated e-mails from Rowe (as
reported by various news outlets) saying she'd look bad if she didn't
fight for custody of Prince, 12, and Paris, 11.

Rowe and White never exchanged e-mails about Jackson, his family or the kids, the suit alleges.

It was unclear how much the lawsuit seeks in damages, Reuters reports."

If what Debbie says is true, you have to wonder: what in the world was Rebecca thinking?! Any money she may have been paid will surely be lost in legal bills and a judgment.

Debbie Rowe's Emails About Seeking Custody

Rebecca White, a woman who claims to be a friend of Debbie Rowe's (perhaps now a former friend), shared emails with Extra that Debbie supposedly wrote about seeking custody of the children after Michael Jackson's untimely death.

On July 2, an email that Debbie is said to have written says:

"I'm not going after custody," Debbie writes to Rebecca. "These kids
are not mine. They were never mine. They were always Michael's. I was
Michael's best friend."

Then, in an email dated July 5, Debbie supposedly wrote:

"My lawyer is telling me I have to take some responsibility about the
welfare of the children," Rowe writes. "Do I want the kids? Hell no.
Does it look good for me to ask for them? Absolutely. I don't want to
look like the woman who gave away her kids and just forgot about them.
Would Michael want Joe to have them? I think it would be the last thing
that he would ever have wanted."

Debbie Rowe Has Not Reached A Final Decision About Custody

Debbie Rowe's attorney said that Debbie is still trying to decide if she wants to seek custody of the two children she had with Michael Jackson.

"Debbie Rowe has not reached a final decision concerning the custody
proceedings," attorney Eric M. George told reporters during a press
conference Thursday. "As many of you know, my belief is that the
pending custody proceedings are the most private and the most sensitive
of matters as they impact the lives and the fates of young children. To
that end, I've endeavored out of respect for Michael's children and
family, especially in this time of grieving, to keep silence on these
matters, to deny all interview requests and to share only that
information involving upcoming public court proceedings."

A reporter for an LA news station reported that Debbie had told him she "want[s] my children," but Debbie's attorney maintained she has not made a final decision.

"I have no reason to doubt that what was reported from that conversation
was accurately and ethically reported, but that said, it would be a
distortion of the truth to allow that single snapshot of a single
conversation, to stand as the truth on Debbie's position on this
sensitive matter."

When the couple divorced in 1999, Debbie reportedly relinquished her parental rights, according to TMZ, although the judge reportedly later reversed the decision to terminate Debbie's parental rights.

Debbie is also said to be willing to take a DNA test to prove she is the older two children's biological mother and she is willing to take all three children to keep them together and would consider obtaining a restraining order against Joe Jackson.

The Jacksons reportedly plan to fight this.

Hopefully this will be resolved before it gets too nasty.

Michael Jackson's Will Filed In Court

An attorney for Michael Jackson filed his will in Los Angeles Superior Court this morning, according to CNN. Here are some of the details that have been made public.

Michael placed his entire estate into the Michael Jackson Family Trust, which is another document that will also be filed with the court today. He asked that his mother, Katherine Jackson, be legal guardian of his three children.

If she was unable, then he asked that Diana Ross serve as his children's legal guardian.

And as for the mother of his two oldest children, Debbie Rowe?

I have intentionally omitted to provide for my former wife, Deborah Rowe Jackson," Jackson's will said.

Well, that's crystal-clear, isn't it?

Hopefully any disagreements will be resolved amicably rather than this turning into a protracted legal battle over custody and assets.

Katherine Jackson Files Guardianship Papers

This morning Katherine Jackson filed guardianship papers for Michael Jackson's three children, according to TMZ. The children have reportedly been staying with her since Michael died last Friday. The guardianship papers say, in part:

As for why Katherine thinks it would be "best" to appoint her guardian,
"Minor children are currently residing with paternal grandmother. They
have a long-established relationship with paternal grandmother and are
comfortable in her care."

The petition states the kids have "no relationship with their biological mother."

The petition says it's "not known at this time" whether the mother (Rowe) agrees that Katherine should be the legal guardian.

As for Prince, Michael's third child, in the box where it says "mother" the box is checked "none."

Debbie Rowe, the biological mother of Michael's two oldest children, reportedly doesn't want custody of the children.

A hearing was scheduled for August 3 to hear the petition.

In the meantime, according to CNN, Katherine was awarded temporary guardianship.

Hopefully the children will be able to stay together and there won't be any big custody battle.
